Terms of Service

What is this?

The Terms of Service (TOS) are the rules and regulations that specify guidelines for using our services. Use of our services is subject to these terms. Please read them carefully and ensure that you understand and agree to all parts. Use of YourHosting’s services implies agreement with these terms!

Acceptance of Terms

By signing up and using any services provided by YourHosting.in, you accept and agree to be bound by these terms and conditions. You must be at least 18 years old or have legal guardian permission to use our services.

Terms of Service

CCHosting, Inc (hereinafter referred to as “YourHosting”) provides web hosting services to people all around the world. We have the responsibility to protect each client and provide them with the best service possible. The following guidelines were designed to ensure that our services remain of the utmost quality. Please read very carefully before ordering and/or using YourHosting services.

Service Usage Policy

You agree to use our hosting services only for lawful purposes. The following are strictly prohibited:

  1. Hosting of phishing pages or any form of malicious websites
  2. Hosting scam or fraudulent sites (e.g. fake e-commerce, fake login pages, impersonation of brands)
  3. Distribution of malware, viruses, ransomware or similar
  4. Hosting or sharing of pornographic, adult or sexually explicit content
  5. Engaging in spam, including email spam, comment spam, or unsolicited marketing
  6. Hosting pirated software, warez, cracking tools or unauthorized copyrighted material
  7. Use of our services for DDoS attacks, botnets or to run proxy/VPN scripts
  8. Illegal activities under Indian or international law

Any account found to be violating the above terms will be terminated without notice and without refund.

YourHosting will be the sole arbiter as to what constitutes a violation of this provision and reserves the right to deactivate and remove any site at any time for any reason.

Phishing, Scam, and Fraud Warning

YourHosting.in strictly prohibits hosting any phishing or scam-related websites.

  1. If we receive a report OR detect any such activity, the account will be terminated immediately.
  2. No refund will be issued in such cases.
  3. We may also cooperate with law enforcement for such reports.

Refund Policy

We offer non-refundable hosting services.

  1. Once a hosting plan is purchased, no refunds will be provided under any circumstances.
  2. This policy exists because our pricing is already set extremely low to support beginners and small businesses.

Resource Usage Limits

While we provide generous resources, you agree not to abuse system resources. This includes:

  1. Excessive CPU/memory usage
  2. Running background processes or cron jobs that consume server power
  3. Hosting illegal file downloads or media streaming platforms

Accounts violating these limits may be suspended or restricted with or without notice.

Copyright Violations

YourHosting will respond to all reports of infringement that are formatted in accordance with the Digital Millennium Copyright Act and any other applicable copyright laws. Notices of infringement that do not comply with this act will not be processed. We will act in accordance with the DMCA when handling infringement reports.

Backups and Data Loss

  1. Users are solely responsible for maintaining backups of their content.
  2. YourHosting.in is not liable for data loss due to hacks, server crashes, or user error.
  3. We recommend keeping regular backups offline or through third-party tools.

Account Suspension and Termination

We reserve the right to suspend or terminate accounts at any time if:

  1. You violate any part of these Terms
  2. We detect suspicious activity linked to abuse, spam, fraud, or security threats
  3. Your actions cause risk or harm to other customers or server integrity

Unsolicited Email (SPAM)

SPAMing, or the sending of unsolicited email, from a YourHosting server or using a return email address that is maintained on a YourHosting server, is STRICTLY prohibited. Using SPAM to advertise a site hosted on YourHosting’s network also constitutes as a violation of this provision. YourHosting will be the sole arbiter as to what constitutes a violation of this provision. Sites found to be in violation of our SPAM policies will be immediately deactivated.

For anyone intentionally spamming on our systems, we reserve the right to bill them at a rate of $90/hour for any cleanup, research, and related work from their illegal activities.

Help us STOP SPAM! Please email our abuse department immediately to report a violation of our SPAM policies.

Support Abuse

At YourHosting, we always treat our customers with the utmost respect. In return, we expect the same from you. If our staff feels that you are consistently addressing them in a demeaning or rude manner, your account may be suspended and you may be asked to take your business elsewhere. In the event that we terminate service for support abuse, customers will be given ten (10) days notice to find a new host.

YourHosting will be the sole arbiter as to what constitutes a violation of this provision. Accounts found in violation of this provision will be subject to immediate account deactivation. YourHosting will turn all available information about abuse incidents, including customer contact data, over to the proper authorities and press charges.

Cancellations

Our Billing department processes cancellations. A cancellation request must be submitted via the client area to cancel an account. Once we receive your cancellation request, our Billing department will confirm your request and process your cancellation shortly thereafter.

We require all cancellations to be requested through the cancellation form inside your client area in order to (a) confirm your identity, (b) confirm in writing that you are prepared for all of your files and emails to be removed. This process aims to reduce the likelihood of mistakes, fraudulent/malicious requests, and to ensure that you are aware that your files, emails, and account may be removed immediately and permanently after a cancellation request is processed.

You must fill out a cancellation request form when you decide to cancel your hosting service. This form helps us understand why you are leaving and ensures smooth cancellation.

In the form, you will be asked to:

1) Describe the Reason for Cancellation: Share your reasons for canceling the service.
2) Choose the Cancellation Type: Select one of the two types of cancellation:

Immediate Cancellation: If you choose this option, your hosting service will be canceled automatically when our system updates at 9 AM Indian Standard Time (IST) daily. For example, if you submit your cancellation request at 8 AM IST, your service will end on the same day at 9 AM IST. However, if you submit your cancellation request after 9 AM IST, your service will end the next day at 9 AM IST.

End of Billing Period Cancellation: If you select this option, your hosting service will continue to be active until the end of your current payment period. Your service will then automatically cancel and end on the due date of that payment period.

Once you have submitted the cancellation request form with all the required information, our Billing team will process your request based on your chosen cancellation type. You will receive a confirmation once the cancellation is complete.

Price Change

YourHosting reserves the right to change prices or any other charges at any time. We will provide you with at least thirty (30) days' notice before charging you with any price change on any annual or longer-term plans. It is your sole responsibility to periodically review pricing on our website and billing information provided by YourHosting through the client area or through other methods of communication, including notices sent or posted by YourHosting.

Late Payments

Any account not paid in full by the end of the Term will be given a one (1) day grace period. If payment is not made within the one (1) day grace period, YourHosting reserves the right to suspend your Services and Also add 49 Rupee Late Fee. YourHosting reserves the right to terminate Services fourteen (14) days after the payment due date  and three (3) days after the payment due date (VPS Hosting). 

YourHosting is not responsible for any damages or losses (including any data) as a result of suspension or termination for non-payment of your account. In addition, YourHosting reserves the right to refuse to reactivate your Services until any and all outstanding invoices have been paid in full and also Reactivation fee of 599 rupee.

Duplicate Payments

A "duplicate payment" is identified as any payment made more than once by a customer for a service, either inadvertently or due to system errors, utilizing a credit/debit card or via PayPal. Common instances of such occurrences (but not limited to) involve active PayPal subscriptions where a customer attempts a manual payment ahead of the automatic PayPal subscription.

Automatic Credit

Upon detection of a duplicate payment by our system, the excess amount is automatically allocated to the customer’s YourHosting account as account credit, pending further action or notice by the customer.

Refund Options

In the event of a duplicate payment, you are presented with two options:

1) Full Refund as Account Credit:

You are entitled to a complete refund of the duplicate payment, which will be credited to your YourHosting account. This credit is applicable to any future purchases or active services with YourHosting.

2) Partial Monetary Refund:

Alternatively, you may opt for a partial refund of the duplicate payment. In this scenario, transaction fees imposed by the payment gateway will be retained by YourHosting, and the remaining balance will be refunded to your original mode of payment.

Notification Period

You are required to inform YourHosting of any duplicate payment within a period of fourteen (14) days from the payment date.

Should YourHosting be notified of a duplicate payment beyond the 14-day period, the option for a monetary refund will no longer be available. The duplicate amount will remain as a credit in your YourHosting account.

Changes to Services and Terms

We may modify or discontinue our services at any time, with or without notice.

  • Terms may be updated periodically. It is your responsibility to check for updates.
  • Continued use of our services after changes indicates your acceptance of the new terms.

Limitation of Liability

Under no circumstances shall YourHosting.in be liable for:

  • Loss of profits, revenue, or data
  • Downtime, interruptions, or delays
  • Any indirect or consequential damages arising from service use or inability to use

Free Migration Policies

Our Migrations Team will make every effort to assist you in transferring your website(s) to our platform. Migrations are provided as a courtesy service; however, we do not guarantee the availability, feasibility, or time required to complete an account migration. Each hosting provider is configured differently, and some platforms store data in formats that are incompatible or proprietary, which may make migration of some or all account data difficult or, in some cases, impossible. As a result, we may not always be able to assist in transferring data from your previous host.

The free migration service applies only to external migrations, meaning transfers from a third-party hosting provider to YourHosting, and is available for sixty (60) days from the date of sign-up. External migrations requested after this sixty (60) day period will incur a migration fee. Internal migrations, which involve transferring data between YourHosting accounts, are not covered under the free migration service and are subject to a migration fee. Please contact our Support department for a price quote on internal migration services or for any additional migration-related inquiries.

In no event shall YourHosting be held liable for any lost or missing data or files resulting from a transfer to or from YourHosting. You are solely responsible for maintaining up-to-date backups of your data at all times.

Failure to Follow Policies

Failure to fully comply with these terms is grounds for account suspension and/or deactivation. Any accounts and/or servers contained within YourHosting’s network must adhere to the above policies.

We reserve the right to remove any account without prior notice. Our normal policy is a warning first, and account deactivation the second offense, but no warning is required.

YourHosting reserves the right to deactivate and remove any site hosted on our servers that contains any content that it deems in its sole discretion to be unacceptable, undesirable, or contraindicated.
